A Tax Ruling Could Complicate California’s Effort to Battle the Drought

The ABA Journal examines the Fourth District Court of Appeal’s ruling in Capistrano Taxpayers Association v. City of San Juan Capistrano – and how it severely impacts water rate structures at a time when tiered water pricing could be a tool for water conservation. Best Best & Krieger Partner Kelly Salt, who represented water agencies as amicus curiae in that case, told the Journal that the decision was not welcomed by the water agencies.

“It just could not have come at a worse time,” said Kelly, who represented the League of California Cities, the Association of California Water Agencies and the California State Association of Counties. “I think about the [timing] as the perfect storm—but we’re not getting any rain out of it.”
