Both cities and affordable housing advocates lauded a recent California Supreme Court decision upholding the City of San Jose’s affordable housing ordinance, Best Best & Krieger attorney Christopher Diaz wrote in an article published today by the Daily Journal. In California Building Industry Association v. City of San Jose, the Court found that the requirement to either construct or provide affordable housing units is a permissible land use regulation. Both cities and the development industry have waited a long time for this issue to be settled.
