Mr. Diven is a partner of Best Best & Krieger in the firm’s San Diego office and is a member of the Best Best & Krieger’s Public Finance and School Law Practice Groups. He has practiced municipal and public finance law for the past 34 years.  For the past 27 years, Mr. Diven has specialized in public finance law, acting as lead counsel in engagements involving the following types of financings or finance issues:

• Community facilities district bonds;
• General obligation bonds;
• Revenue bonds and Certificates of Participation;
• School facilities mitigation agreements;
• Marks-Roos bonds;
• Tax increment bonds;
• Assessment district bonds;
• Municipal securities disclosure;
• Development impact fees;
• Assessment district and community facilities districts foreclosure proceedings; and
• Restructuring and workouts of distressed assessment districts and community facilities districts.

 Mr. Diven is an active member of the National Association of Bond Lawyers and the CASH Legal Advisory Committee.  Additionally, he serves on CASTOFF, a state-wide committee of bond lawyers, financial consultants and underwriters addressing issues pertaining to assessment and community facilities district financing.  Mr. Diven has served as a speaker and lecturer on Proposition 39, community facilities district and assessment district financings, Proposition 218, judicial foreclosure proceedings for community facilities districts and assessment districts, restructuring and workouts of distressed  community facilities districts and assessment districts and primary and continuing disclosure for various organizations, including the Coalition for Adequate School Housing (CASH); the continuing education programs of UCLA, UC Davis and UC San Diego; the League of California Cities; the City Attorneys Associations of San Diego, Riverside and San Bernardino Counties; and the American Public Works Association chapters of San Diego and Los Angeles Counties.

 Mr. Diven received his A.B. degree from Kenyon College, Gambier, Ohio, in 1967, and his law degree, with scholastic merit, from the Thomas Jefferson School of Law, San Diego, in 1976.
