Air Quality Litigation

Litigation

Air quality litigation is driven either by industry fighting regulation or environmentalists insisting on greater oversight, but in either event, can be a legal morass.

As counsel for public agencies, BB&K understands both perspectives, as well as the legal complexities.

Since 1999, BB&K has served as special litigation counsel to the South Coast Air Quality Management District (SCAQMD) on air quality issues. Consequently, we have seen challenges from environmental groups claiming the SCAQMD has not gone far enough to control air pollution. Conversely, we have witnessed claims by industry groups asserting the SCAQMD has gone too far. Understanding the middle-ground is key to successful representation in litigation. BB&K's unique experience enables it to see this balance and develop common-sense litigation strategies for complex air quality cases.
